WKD Secures First Jury Verdict in Favor of Insurer Stemming from 2020 Louisiana Hurricanes

Peter Wanek, WKD Managing Partner, secured the first jury verdict in favor of a homeowner insurer in Louisiana stemming from the hurricanes in 2020. In Charles and Erica Jackson v. State Farm Property and Casualty Co., WKD received a defense verdict for their client in the United States District Court, Western District, before Hon. David Joseph, on March 6-9, 2023.

The plaintiffs filed a suit claiming property damage from Hurricanes Laura and Delta which were unpaid by the defendant, State Farm. Damages included a claim that additional damages totaled more than $324,000. The plaintiffs also claimed damages for penalties and attorneys fees under LSA-R.S. 22:1973 and 22:1892. The jury ultimately rendered a defense verdict for State Farm.
