Maurice Landry v. USAA General Indemnity Co. and the United States Auto Association


Docket No. 2019-12497, Peter Wanek and Lindsay Faulkner obtained a defense verdict following a three-day jury trial in August 2022 in the 22nd Judicial District Court for the Parish of St. Tammany. The plaintiff sued USAA as the UM insurer for the plaintiff, Maurice Landry, regarding alleged injuries that he suffered from a motor vehicle accident in 2018. The allegations included injuries to Plaintiff’s neck, necessitating the need for a three-level cervical fusion, and an additional keloid surgery related to the cervical surgery incision. Plaintiff also alleged that he suffered low back injuries because of the motor vehicle accident and was scheduled to undergo lumbar fusion surgery. Plaintiff also alleged that he was entitled to past and future lost earning capacity and fringe benefits. Plaintiff asked the jury to award $1.8 million in damages from USAA as liability insurer for the second driver, and from USAA as the UM insurer for the Plaintiff. After three hours of deliberations, the jury awarded a total of $29,004.00, which did not in fact trigger any liability from USAA as the UM insurer. (See link to Verdict)
