Claude Rigmaiden et al v. State of Louisiana


Peter Wanek obtained a defense verdict in a jury trial from August 8-12, 2022, in the Civil District Court in New Orleans. The plaintiffs, the parents of a six-month-old infant, sued a doctor employed by the State of Louisiana/LSU Health Sciences Center, alleging that the child was prematurely discharged from the hospital with undiagnosed pneumonia and that the child died three days later. The plaintiffs claimed damages were owed for wrongful death. After about three-and-a-half hours of deliberation, the jury concluded that the doctor did not contribute to or cause the infant’s death, dismissing the claims against the defendants. The jury was polled and the result was 11-1.
