Reggie Ann Washington v. Andrew Fink and USAA

Hon. Michael Clement, 23rd Judicial District Court, Plaquemines Parish; Plaintiff alleged she suffered bodily injuries following a rear-end auto accident that occurred on Highway 23/Belle Chasse tunnel. Prior to trial, the primary carrier settled for policy limit of $100,000. Plaintiff had two bilateral rhizotomies in her lower back, as well as multiple ESIs in her neck. Medical specials were approximately $48,000, and the plaintiff claimed she needed an endoscopic rhizotomy in her lower back at a future cost of $58,000. Jury awarded just $30,000, which included $17,000 in general damages and just $10,000 in medical specials. Jury also found an unnamed party 85% fault and tortfeasor just 15% fault, resulting in a net verdict amount of just $4,500.00. With credit of $100,000, net award was $0. (See link to Verdict)
