Walter and Kathleen Lyons v. State of Louisiana through the LSU Health Sciences Center
Peter Wanek tried a case in the 24th Judicial District Court, Parish of Jefferson, before Hon. Nancy A. Miller, March 13-19, 2023. Plaintiffs filed suit alleging that Mr. Lyons suffered radiation burns to his left hand/arm and lower back as a result of a complex fluoroscopy procedure performed by surgeons employed by defendant, which allegedly led to the multiple debridement procedures, plastic surgery skin grafts, and the amputation of plaintiff’s left arm below the elbow. Plaintiff alleged past medical expenses of approximately $700,000 with claimed future medical expenses of over $300,000. Plaintiff’s settlement demand never came below $1.9 million. Jury ultimately awarded a total of $252,000, which included $100,000 for loss of consortium, and allocated fault of 25% for the defendant and 75% to the plaintiff. The net verdict amount to defendant was $63,000, with each party to bear their own costs. See link to Judgment.
