In the 24th Judicial District Court for the Parish of Jefferson, Peter Wanek and Seth Pohlmann secured a Motion for Summary Judgment (MSJ). The plaintiff alleged that he bit into a fried pie and the filling spilled onto his chin, causing him burns. The WKD team argued that, under the Louisiana Products Liability Act, the pie was not unreasonably dangerous and that the defendant had no duty to warn the plaintiff that the fried pie was hot. See link to MSJ.
Trevor Davies and Michael Ballero obtained a defense verdict in the U.S. District Court for the Eastern District of Louisiana. Judge Eldon E. Fallon presided over the two-day trial. After two hours of deliberation, the seven-person jury returned a unanimous verdict for WKD’s client. The plaintiff’s final demand before trial was $225,000. See link to the verdict.
US District Court for the Western District of Louisiana (Hon. Judge Dee Drell presiding), July 31-August 2, 2023, Lindsay Faulkner and Peter Wanek secured a defense judgment after a jury trial in an employment discrimination case. The plaintiff claimed he was discriminated against by the defendant on the basis of race and age in his failure to be promoted. Further, the plaintiff made claims of retaliation and harassment. He claimed damages in excess of $300,000, including economic damages, compensatory damages, punitive damages, and attorney’s fees. After a three-day jury trial, the federal judge granted a judgment as a matter of law dismissing all age discrimination claims, retaliation claims, harassment claims, and a majority of the race discrimination claims. The remaining claims were eventually dismissed, resulting in a defense judgment for the defendant.
