We have reached successful outcomes for many clients in a broad range of matters. Here is a partial list of our achievements over the past decade:

Recent Victories

Joyce Landry v. DG Louisiana, LLC - Peter Wanek, Kathryn Trew, and Lindsay Faulkner secured summary judgment in favor of a retail client in a case pending in the 21st Judicial District Court for the Parish of Tangipahoa. In that case, the plaintiff claimed that she was injured at a retail establishment when she slipped and fell on water on the ground. The Court granted summary judgment in favor of the defendant merchant reasoning that the plaintiff failed to produce evidence that the defendant created the condition or had actual or constructive notice of the condition’s presence. (See link to Court’s opinion)

Wanda Henderson v. Haza - Peter Wanek, Kathryn Trew, and Lindsay Faulkner secured summary judgment in favor of a retail client in a case pending in the United States District Court for the Eastern District of Louisiana. In that case, the Plaintiff claimed that she slipped and fell at a retail establishment. She further claimed that she underwent a knee surgery as a result of the injuries she sustained in the accident. Federal Judge Sarah Vance granted summary judgment in favor of the defendant merchant. She reasoned that the action was prescribed as it was not timely filed against the defendant merchant and dismissed the case with prejudice. (See link to Court’s opinion)

Lisa Hill v. Hobby Lobby - Peter Wanek, Kathryn Trew, and Lindsay Faulkner secured summary judgment in favor a retail client in a case pending in the 24th Judicial District Court for the Parish of Jefferson. In that case, the plaintiff claimed that she injured herself when a chair in which she was sitting at the retail establishment “broke and collapsed from under her.” The Court granted summary judgment in favor of the defendant merchant reasoning that the plaintiff failed to produce evidence that there was any defect in the chair or that the defendant had actual or constructive notice of any alleged defect.  (See link to Court’s opinion)  

Renetta Glover v. DG Louisiana, LLC - Peter Wanek and Kathryn Trew secured a defense judgment in favor a retail client following a bench trial before the Honorable Wilson Fields in the 19th Judicial District Court for the Parish of East Baton Rouge. In that case, the plaintiff tripped and fell at a retail establishment. Plaintiff claimed that the accident caused injuries requiring her to undergo two surgeries and multiple injections. Judge Fields found that based on the testimony of the plaintiff’s treating physician and the surveillance video of the incident, the plaintiff could not have been injured in the incident. (See link to Court’s opinion) 

Adrium Parker v. Cajun Operating Company (of Delaware) - Peter Wanek and Kathryn Trew secured summary judgment in favor of a retail client in a case pending in the 18th Judicial District Court for the Parish of West Baton Rouge.  In that case, the plaintiff claimed that she was injured at a retail establishment when she slipped and fell on a substance on the ground. The Court granted summary judgment in favor of the defendant merchant reasoning that the plaintiff failed to produce evidence that the defendant created the condition or had actual or constructive notice of the condition’s presence. (See link to Court’s opinion)
